NOTICE Related to H-2A Program in Washington State – July 21, 2025

The U.S. District Court for the Western District of Washington has issued a modified preliminary injunction order in Familias Unidas Por La Justicia v. DOL, et al., No. 24-cv-00637 requiring the U.S. Department of Labor to take the following action, among other provisions:

  • Request Washington ESD post a notice on its WorkSource website with all active applicable piece-rate prevailing wage rates for Washington, and which states that all relevant employers employing workers in a specific crop or agricultural activity must offer and pay the applicable active prevailing piece rate wage for work performed in Washington, and asking that such notice remain publicly available until 50 percent of the work contract period lapses for the relevant certifications.

On June 19, 2025, USDOL published updated prevailing wage information based on the ESD prevailing wage surveys submitted on August 15, 2023. The updated prevailing piece rate wage information is represented in the table below.

As such, ESD hereby notifies H-2A employers as follows:

  1. All relevant [H-2A] employers employing workers in a specific crop or agricultural activity must offer and pay the applicable active prevailing piece rate wage for work performed in Washington;
  2. This notice shall remain publicly available until 50% of the work contract lapses for the relevant certifications.
  3. The active applicable piece-rate prevailing wages for WA are as follows:

Please note that USDOL H-2A regulations provide that if the prevailing wage rate is adjusted during a work contract, and is higher than the highest of the AEWR, a previous prevailing wage for the geographic area and crop activity or agricultural activity or, if applicable, a distinct work task or tasks performed in that activity, the agreed-upon collective bargaining wage, the Federal minimum wage, or the State minimum wage, the employer must pay at least the higher prevailing wage rate beginning on and after the Date of Notice from the USDOL’s Office of Foreign Labor Certification (OFLC). See 20 CFR § 655.120(c)(3). Additionally, if the adjusted prevailing wage(s) is lower than the wage rate guaranteed on a current job order, the employer must continue to pay at least the wage rate guaranteed on the job order. See 20 CFR § 655.120(c)(4). If a prevailing wage that was guaranteed on a job order expires during the work contract, the employer must continue to guarantee at least the expired prevailing wage rate. See 20 CFR § 655.120(c)(2).

H-2A Agricultural Clearance Orders
The H-2A program establishes a means for agricultural employers who anticipate a shortage of domestic workers to bring non-immigrant foreign workers to the United States to perform agricultural labor or services of a temporary or seasonal nature.
